Introduction
The cancellation policy ensures clarity and fairness in ending services between Advent Trinity Marketing Agency and its clients. This policy applies to all clients and services provided by the agency and establishes the process and expectations for cancellations.
Cancellation by the Client
- Notification Requirements
Clients must provide a 30-day written notice of cancellation using the designated Cancellation Form. - Fees and Penalties
- There are no cancellation fees if the contract has been completed in full.
- If the contract is canceled mid-term, clients are required to pay the outstanding balance of the contract.
- After the cancellation, an offboarding meeting will be scheduled to transfer company assets, such as moving the website to the client’s host.
Exceptions: Cancellation fees may be waived under extraordinary circumstances, such as emergencies.
Cancellation by the Agency
- Notification Requirements
The agency will notify the client in advance if it decides to terminate services. - Refunds and Resolutions
- Refunds are generally not provided, but credit may be issued for future services.
- Refunds are only available on a case-by-case basis, at the agency’s discretion.
Termination of Ongoing Contracts
- For Monthly Retainers or Subscriptions
A 30-day notice period is required for termination. Any remaining work will be completed or handed over as per the agreement. Final invoices will account for outstanding balances and deliverables provided up to the termination date.
Impact on Work in Progress: Unfinished work will be paused and provided to the client after the settlement of all financial obligations.
Non-Refundable Items
- Non-refundable items include:
- Third-party costs incurred during the project.
- Deliverables that have been completed and delivered to the client.
- Partial refunds may be considered under exceptional circumstances.
Force Majeure Clause
In cases of uncontrollable events such as natural disasters, emergencies, or other unforeseen circumstances, the following may apply:
- Fees may be waived or adjusted.
- Services may be paused or rescheduled without penalty.
Reinstatement Policy
If clients wish to reinstate canceled services:
- Contact the agency to discuss terms and conditions.
- A reinstatement fee may apply, based on the nature of the services being resumed.
Dispute Resolution
All disputes regarding cancellations will be resolved through mediation or arbitration. The laws of the state in which the agency operates will govern these disputes.
Amendments and Updates
This policy is subject to change. Clients will be notified of any updates in advance, and changes will be reflected in the updated terms.
Acceptance of Policy
By proceeding with services, clients agree to the terms outlined in this cancellation policy. Acknowledgment of the policy will also be obtained during the onboarding process.
